1. ACCEPTANCE OF THE TERMS

Any person accessing the Website shall be subject to the following Terms of Use.

GM is not liable for any presumable damage caused by the use of the Website and its content and reserves the right to change the terms of use at any time, at its own discretion.

Therefore, Internet users agree that GM may not be questioned on any changes, suspension or cancellation of the Website and its services.

2. WAIVER OF LIABILITY

GM shall not be liable for the contents, opinions and comments of visitors. The content published by users is not constantly reviewed or monitored by GM.

At any time, GM may also leave out any content from its Internet portal or partially and fully exclude any of the contents available to the visitors of the Website in case it considers that its contents breach legal standards in force or due to claims, without this meaning any liability for GM or rights for the user.

GM shall not be liable for any problems, failures or technical issues, of any type whatsoever, of computer networks, servers or providers, computer equipment, hardware or software, or error, interruption, defect, delay or failure in the operations or transmission for the correct processing of any subscription, including, without limitation, the imprecise transmission of information or the failure of GM to receive them, due to technical problems, Internet congestion, virus, bugs or hackers.

3. PUBLICATION

In case users opt for posting any content in the Website, they must comply with the following rules with regard to content, form and style.

Content

• Do not quote or disclose competitive products or services of GM.
• Do not write incorrectly the name of companies, products or trademarks.
• Do not use offensive, obscene or rude terms.
• Do not create texts where the result of clicking causes the downloading of a file.
• Do not generate an ad which content discloses telephone numbers or e-mails.

It is prohibited to publish, disclose, disseminate or post on the Website under any reason whatsoever:

• Images of persons without prior authorization;
• Pornographic material or related with illegal activities;
• Rude and/or offensive material and/or language;
• Practice, induction or incitement to prejudice with regards to origin, race, ethnic origin, gender, sexual orientation, color, ideas, religion, or any other form of discrimination;
• Slanderous, abusive material or which invades the privacy of any person;
• Obscene or pornographic images and/or language;
• Insulting or slanderous statements;
• Information on illegal activities and incitement to crime;
• Information related to piracy of material protected by copyrights and trademarks;
• Disclosing as own or without due authorization names, contacts and any other information from third parties;
• Political propaganda for candidates, political parties or coalitions, either as propaganda related to their organizations or representatives;
• Advertising banners;
• On-line sales;
• Programs and files containing virus or any other malicious code;
• Material in breach of any local, state or federal law of Brazil;
• Material which becomes virtual crime.

4. GM’s RIGHTS

GM also reserves the right to reproduce and publish photos, videos or parts of pages that have been eventually created in its interactive Websites in any media and at any time.

5. PARTICIPANT’S LIABILITY

In case there is any content published in the Website, it is hereby stated that such content shall be the sole and exclusive, civil and criminal liability of the user that produces it.

Users may not post videos, photos, texts and audio that are protected by copyrights, even less post any other type of content without the Express authorization of the author or his/her legal representative. No images of persons without their previous written authorization may be posted.

Likewise, users that develop images and text for third parties must obtain the license to use such images, since the works may be shown at the Website, and GM shall not be held liable for the illegal use of images and statements made by users.

6. JURISDICTION AND GOVERNING LAW

In order to solve any dispute derived from this instrument, the parties agree to subject themselves to the jurisdiction of the courts of the city of São Caetano do Sul. Any dispute that may arise by virtue of this instrument shall be governed by the Laws of Brazil.
